摘　　要：外国投资国家安全审查立法历来是东道国管理外国投资的"安全阀"之一,发挥着平衡国家安全与投资需求的重要作用。从这一立法演进的角度来看,外国投资国家安全审查立法的探索与创新本就是不断地适应或引领外部投资环境以及内部经济基础变革所带来的新形势、新发展的结果。在中国(上海)自由贸易试验区着力实行外商投资准入新模式的背景下,我国的外国投资国家安全审查立法应该审时度势,在自贸试验区内进行适当的优化与调整,来为未来推行的"准入前国民待遇加负面清单"外资管理模式提供"先行先试"的有益经验。The exploration and innovation in the legislation in security review of foreign invcstmcnt originally arisen from the result of suiting or leading the new trend and development from the change of external investment environment and internal economic fundamental. Our country＇s legislation in security review of forcign investment, in thc new governing model for foreign investment within the China （Shanghai） Pilot Free Trade Zone, shall adjust smoothly in order to become useful experience for new governing model on foreign investment of ＂Pre-entry national treatment＂ plus ＂negative lists＂ .
