摘　　要：《行政许可法》在规范规划行政许可中存在一些瑕疵,尤其是在听取意见程序上,具体表现在听取意见程序规定过于原则抽象、公开程序和最终意见回馈机制不够详细等方面。要解决上述问题,就必须严格进行程序控制。具体程序设计包括:完善其中的受理公告制度,保障利害关系人的参与权;引入代理人制度和专家辅佐人制度;促使行政机关及时反馈。以期切实保护规划行政许可中当事人的权利,真正做到依法行政。There are some defects in the regulation of the planning of administrative license in Administrative Licensing Law, especially in the hearing procedure. It is reflected in the abstract general provisions and the lack of public procedure in details and response mechanism in administrative organs and so on. In order to solve these problems, it is required to standardize the operating procedures. The details of actual system include： to improve the acceptance notice system, to protect the interested party＇s participation right, to introduce the agent system and the expert system and the system of expert assistant. Through the improvement of the systems, it is hoped the parties＇ rights are protected effectively in planning administrative license and that the administrative organs do the administrative behavior according to the law.
