华为对美专利审批状况分析

摘　　要：以国民待遇原则为出发点,对我国企业对外专利审批现状进行研究。选取具有领域代表性的创新主体华为,对其在美申请以申请年份归类,对比研究其对美申请与同领域竞争对手以及该领域的平均审批周期、审查状态与结果、法条的应用等,比较我国创新主体对美审批过程中与竞争对手之间存在的差异,并对产生该差异可能的原因进行分析,为我国创新主体对外专利申请提供参考信息和建议。This paper takes principle of national treatment as the starting point,studies the present situation of Chinese enterprises＇ foreign patent examination and approval. It selects the innovative subject Huawei with field representative,classifies its patent applications in America according to application time,makes comparative study toward its application in America and the same field competition opponents,and as well as the average approval period of the field,examination status and results,application of articles of law etc.,compares differences between China＇s innovative subjects in the process of examination and approval in America and the competitors,and analyzes the causes of the differences,to provide reference information and suggestions for Chinese innovative subjects＇ foreign patent application.
