龙泉司法档案中的现代法治理念“人权保障”

摘　　要：浙江龙泉司法档案是对龙泉地区晚清至民国这段时间司法实践活动的真实记载,以丰富详实的史料弥补了民国司法资料奇缺之遗憾。研究档案材料发现,众多的真实案例材料富含当代"人权保障"法治理念之缩影,通过对档案材料的探索与研究,以对当代法治发展有所裨益。The judicial archives of Longquan in Zhejiang provides a real record of the judicial practice implemented in this region during the period of the late Qing Dynasty and Republic of China. These files and documents with their rich and detailed historical information fill the gap in the local judicial data. This paper makes an investigation of this data and reveals that many of these real cases make a good epitome of ＂human rights protection＂, the modern idea of the rule of law. And the author hopes the research into this archive material will be helpful to the development of the modern rule of law.
