摘　　要：国际投资协定中外汇转移条款之间存在着较多的冲突,既包括双边投资协定之间的冲突,也包括投资协定与多边条约之间的冲突。本文认为,并不是所有的条约冲突都是真实的条约冲突,只有不能通过条约解释予以避免的冲突才是真实的冲突。解决国际投资协定中外汇转移条款冲突的主要方法是在缔约过程中对核心概念进行明确的界定,并且限制投资争端解决机构的任意解释权。There exist many conflicts between the international investment agreements in terms of foreign exchange transfer clause,which include both the conflicts between bilateral investment agreements and the conflicts between investment agreements and multilateral treaties.This paper argues that not all treaty conflicts are real and only conflicts which cannot be avoided by treaty interpretation are true conflicts.The main method to solve the conflicts of foreign exchange transfer clause in international investment agreements is to clearly define the core concepts in the contracting process and to limit the arbitrary power of interpretation by the dispute settlement mechanism of investment.
