美国法院遵循先例的运行机制及启示

摘　　要：中国法中案例指导制度的知识资源主要源于英美法领域(尤其是美国法)的先例遵循制度,但是,美国法院的先例在实践中被遵循的情况却极为复杂。经过法律现实主义的洗礼,先例在美国法院裁判过程中的绝对地位虽被动摇,但主导地位仍在,这成为分析美国法院先例被遵循现状的一个前提。基于实证文献的考察,在审级维度上,高层级法院的先例在不同低层级法院的效力并不一样,低层级法院遵循先例的缘由主要也不是担心自己的判决在未来被推翻。在非审级维度上,联邦法院的先例在州法院及州法院的先例在联邦法院的被遵循情况具有很强的不确定性,甚至很难称为"先例遵循"。这些运行实践的复杂性为思考中国裁判制度改革提供了实证的和技术的视角与借鉴。China＇ s guidance case system is a product of learning the stare decisis in American legal context. However, through the analysis of the empirical literature and practical operation, it is found that stare decisis in America is very complicated. Although abiding by the precedent is still the major factor while judicial decision is made, the influences of precedent made by superior court are different in different jurisdiction. Besides, the precedent made by federal court would only be abided by state court to a certain extent.
