体育法学概念的再认识

摘　　要：在对国内外关于体育法学概念的诸多观点进行批判性探讨的基础上,将体育法学定义为研究体育法和应用于体育的法及其体育法律现象的一门学问。体育法学概念的外延包括国际体育法、国家体育法、固有体育法和存在于群众体育、竞技体育、学校体育、体育产业以及体育各相关领域中的法律现象。体育法学的学科性质是体育学与法学的交叉学科,其主要研究方法有法律解释法、法社会学方法、法哲学方法、比较法学方法和判例分析方法。On the basis of a critical study into various views on the concept of sports law both at home and abroad, thisthesis defines sports law as a study of laws and regulations of sports, laws applied to sports and their legal phenomena.The denotation of sports law includes international sports law, national sports law, intrinsic sports law and legal phenomenaexisted in mass sports, athletic sports, school sports, sports industries and all fields related to sports. By disciplinarynature, sports law is an interdisciplinary subject of both of sports and laws. Its major researching methods includelegal interpretation, legal sociology, legal philosophy, comparative legal studies, and case analyses.
