摘 要:浙江湖州教案(1902-1908)是晚清少有的通过法律途径成功解决的教案之一。在此过程中,一批有留洋经历和熟悉洋务的新派士绅起了主要作用。他们通过与教会谈判、请求美国领事和公使仲裁等方式解决纠纷,并两次将南监理会和传教士告上法庭,最终通过庭内和解的方式与教会达成协议。士绅们力主"文明抵制",约束民众,使得湖州教案的性质始终限定在租房买地领域,而未演变成杀教士、毁教堂的恶性外交事件。湖绅在本案中的作用,也凸显了晚清民教和解的"去官府化"特征。湖案两次详细的庭审过程,是晚清民教地产争讼类案件在近代西方法律语境中的真实演绎,弥足珍贵。The Huzhou island case in Zhejiang province was a rare case that was satisfactorily solved via legal procedure in late Qing dynasty. In the course of it,a passel of neo-gentry,who either studied abroad or were familiar with the foreign affairs,played the key role. They negotiated with the church,and requested the American consul and envoy to arbitrate the dispute. What's more,they brought the lawsuit to court twice against the missionaries and southern supervisory board. Finally,they reconciled with the church in court and got an agreement. The gentries strongly proposed to boycott in a civilized way all along. This made people act on constraint,which kept the case in the nature of disputes on renting and estate trading. Hereby,they avoided getting involved with the affairs of murdering missionary and destroying church. The Huzhou gentry's optimistic role in the case embodied the non-government characteristic in reconcile between the church and people in late Qing dynasty. The two concrete procedures of the trial were the actual practice to handle a church-people estate dispute in modern western legal context. Therefore,it is invaluable.
