医患纠纷第三方调解的绩效困境与创新路径

摘　　要：近年来,第三方调解在化解医患矛盾过程中发挥了重要作用,并日渐成为调解医患纠纷的主导模式。但从其调解绩效来看,与其他模式一样,同样也存在许多亟待改革与完善的地方。如人民调解执行率不高、行业调解法律效力差、保险调解理赔难度大等均严重影响了第三方调解绩效。为此,有必要从明确人民调解的法律地位、规范行业调解的行为准则、解决保险调解理赔难问题等几方面出发,提高人民调解的权威性、提升行业调解的公信力、提高保险调解的认可度。In recent years,the third party mediation plays an important role in the process of resolving the contradiction between doctors and patients,and gradually become the dominant mode of medical dispute mediation.But from the mediation performance,like other models,it also exist many urgent needs to reform and perfect.The performance of the third party mediation were seriously affected by such factors as lower implementation rate of the people＇s mediation,the poor efficiency of mediation,the difficult of insurance mediation claims.Therefore,from the aspects of clearing the people＇s mediation＇s legal status,regulating industry mediation behavior criterion and solving the difficult problem of insurance cleavage compensation,it is necessary to improve the people＇s mediation＇s authority,enhance the credibility of the industry mediation and improve the recognition of the insurance mediation.
