期刊名称的防抢注策略研究

摘　　要：期刊名称具有商标的作用,在被他人抢先申请商标注册时,可作为未注册商标寻求商标法的保护,阻止他人的抢注行为。欲达此目的,期刊社要提供有针对性的证据证明:期刊名称具有商标的属性;期刊名称已投入使用并有一定影响;抢注人采用不正当手段。Journal name possesses the function of trademarks and can be used as an unregistered trademark to seek protection by Trademark Law when it is first registered by others so as to prevent the cyber-squatting behavior of others. For this purpose,the journal has to provide targeted evidence： journal name has attributes of trademarks; journal name has been put to use and has some influence; people cyber-squatting have used unfair means.
