摘 要:相对完备的农业产业化立法是构建农业产业化经营有效机制的根本保障,可从精神领域、形式领域、内容领域来具体分析我国农业产业化立法可能的发展完善路径。精神领域的发展主要表现为价值目标方面,应充实农民参与规范以平衡相关立法价值目标的作用对象;形式领域的发展主要表现为立法体例方面,应清理相关立法以实现立法的规范性转向;内容领域的发展主要表现为立法内容方面,应编纂相关立法而就产业化龙头企业问题、农业产业链问题和多元产业利益联结格局问题予以系统化规定。Relatively complete agricultural industrialization legislation is the fundamental guarantee to build effective indus- trialization operation mechanism of agriculture. We can analyze the probable developing and perfecting paths of China' s ag- ricultural industrialization legislation in the perspective of spiritual realm, formal realm and content realm. The development of spiritual realm mainly manifest as the aspect of value target, we should enrich the farmers' participation norm to equilibrate the action object of relevant legislation' s value target. The development of formal realm mainly manifest as the aspect of legislative style, we should clean up the relevant legislation to realize legislative normalization diversion. The development of content realm mainly manifest as the aspect of legislative content, we should codify the relevant legislation to set systematization rules of three problems, such as industrialization corporate champion problem, agricultural industry chain problem and links pattern problem of diversified industry interests.
