接续与超越中国新闻法制传统的路径选择  

To Follow and Surpass the Traditions of News Legal System of China

摘　　要：中国新闻法制存在两个有价值的传统:注册登记制、平衡理念。我国新闻法制建设必须直面现实、注重方法、讲求实效,善于从历史传统中汲取资源,开拓接续传统、超越传统的法制建设新思维。接续、超越这些传统的路径有四条:首先,从两个新闻法律的邻接性文本——新闻道德和传媒司法——中找到中国新闻法制建设的启发性出口;其次,在中国新闻法制建设无本质突破的现实中发现前进的坦途,即压力型立法的路径:一是传播科技压迫新闻法制变革,二是具有"痛感"和"快感"之事逼迫新闻法制发展。There are two valuable traditions in China＇s news legal system： the registration system and the philoso- phy of balance. In constructing our country＇s news legal system, we have to face the reality, choose the right methods in order to pursue the practical result. We have to develop new ways of thinking to promote the construction of Chinese news legal system. Also, we must continue and surpass the tradition of the construction of China＇s news legal system by using the resources drawn from history and tradition. There are four ways to follow and surpass the traditional routes： First, the illuminating outlet for china＇s construction of the news legal system can be found in two closely connected re- spects news morality and media justice; Then, more feasible ways to continue the construction of the news legal sys- tem, namely the legislative paths of pressure type, should be found, though there is no essential breakthrough in the practical construction of Chinese news legal system. The legislative paths of pressure type means that, on the one hand, new communicating technologies, on the one hand, force the change of the news legal system; some big events, with pains and pleasures, drive the development of the news legal system.
