农村土地使用权流转机制立法探索

摘　　要：农村土地使用权流转对城乡一体化发展和农民权益保障具有重要意义。但现有农村土地使用权的流转存在诸多问题。从宏观上看,农村土地流转制度相互冲突,流转主体不明确,流转范围和方式存在限制,实施困难。在具体的环节中,无论是农村土地承包经营权、集体建设用地使用权,宅基地使用权的设立、流转,还是配套的保障措施的形成上都存在较大漏洞。针对这些问题,应从立法方面进行推进,取消对农村土地使用权流转的不合理限制,形成科学、可操作的流转程序,完善相应的登记制度,探索农地以用代征的新路径,建立起与当前社会发展相适应的农村土地使用权流转法制体系。The transferring of rural land-use right is of significance to develop urban-rural integration and protect farmers＇ right.However,there are many problems in the transferring of rural land-use right.In the macrolevel,they can be summarized to the contradictions in the system of institutions,uncertain body,unreasonable limitations of scale and methods,and the difficulty of merits achieving in the transferring of rural land-use right.In detail phases,there are some serious deficiencies of establishment and assignation in rural contracted-land right,collectively-owned construction land right,homestead right,as well as the protections.Therefore,it is necessary that the legislation must be promoted,unreasonable limitation of transferring of rural land-use right should be canceled,scientific and operable procedure need to be found as well as the registration.It is also important to find a way to replace levy by exercising,and establish a legal system of transferring rural land-use right in accordance with the development of society.
