法律多元视角下的体育法概念

摘　　要：因法律观念、法律文化以及体育法实践不同,国内外学者对于体育法的认识存在很大的差异,对于体育法究竟是什么,至今没有一个清晰的概念。在法律多元的视角下,通过对"体育法"是否就是"体育与法"、体育法(Sports Law)是否等同于"Lex Sportiva"、体育法中的"体育"的定义是什么等问题的探讨,将体育法定义为:体育法是构建体育秩序的规范体系。体育秩序包括体育社会秩序和体育行业秩序两个层次,规范体系包含体育国家法和体育自治规范,体育国家法分为国内体育法和国际体育法两个层次,体育自治规范分为国内体育自治规范和全球性/超国家性体育自治规范两个层次。At present,there is a big difference on the concept of sports law between the Chinese and foreign scholars due to the different legal concept,culture and sports law practice.Furthermore,there is no clear concept of sports law.In this paper,whether sports law is sports and law,whether sports law is Lex Sportiva,and what sports mean in the sports law are discussed from the legal pluralism perspective.It is held that sports law is a norm regulating the sports order,which includes sports social order and sports industrial order.The norm contains state sports law and sports autonomous rule.State sports law includes national sports law and international sports law.Sports autonomous rule includes national sports autonomous rule and global/supernational sports autonomous rule.
