十四大以来中共中央历次工作报告的法治探微

摘　　要：中共十四大在改革开放的背景下提出建立社会主义市场经济的战略目标,市场经济的契约性与法治性内涵就此开启了中国的法制建设与法治发展之路,尤其是党中央工作报告正式使用"法治"一词以后,人们对"法治中国"的建构历程充满了激情与希望。十四大以来历次党中央工作报告对法制或者法治的重要论述,共有八个方面的法治变迁与有益经验:从"法制"到"法治"的价值理念提升、从"依法行政"到"法治国家"的范围拓展、从"依法行政"到"依法执政"的主体延伸、从"权力机关立法"到"民主参与立法"的过程优化、从"增加立法数量"到"加强立法质量"的绩效改善、从"加强立法与严格执法"到"推进司法体制改革"的体系完善、法律文本创制与普法宣传教育并重的规则宣导、法制或者法治体制完善与人员队伍建设并举的资源整合。这无疑会使中共十八大之后的法治建设路径更加清晰明朗,法治建设过程的优化更加具有针对性。The 14 th CPC Congress put forward the strategic goal of establishing the socialist market economy under the background of the reform and opening-up,thus the nature of the contract and the rule of law about the market economy opened the road to the construction of legal system and the rule of law development of China,especially after the Party Central Committee work reports formally used the word ＂ rule of law＂,people are full of passion and hope for the process of the construction of ＂ The Rule of Law of China＂. Reviewing on the important exposition on the legal system or the rule of law in the Party Central Committee work reports since the 14 th CPC congress,there are eight aspects of the change of the rule of law and the beneficial experience： the promotion of the idea of value that from the legal system to the rule of law,the expansion about the scope from ＂ administrating by law＂ to ＂ country ruled by law＂,the subject＇ s extension of from ＂ administrating by law＂ to ＂ ruling according to law＂,the optimization of the process of from ＂ the legislation of the organizations of power＂ to ＂ the democratic participation in the legislation＂,the improvement of the performance of from ＂ increasing the amount of legislation＂ to ＂ strengthen the quality of legislation＂,the system＇s perfecting of from ＂ strengthening the legislation and enforcing the law strictly＂ to ＂ promoting the reform of the judicial system＂,the awareness of rules that stress on the formulation of the text of the law and the popularization,propaganda and education of laws,the integration of the resources that perfecting the legal system or the system of the rule of law and the construction of the staff promoting simultaneously. This will undoubtedly make a clearer path of the construction of rule of law after the 18 th Congress of the CPC and make the construction of rule of law perfect and targeted.
