摘　　要：矿害责任在我国并未得到应有重视,其规制规则简单粗疏,不能为受害人提供有效救济,制度供给不能满足司法需求。应以危险责任法理为基础,以无过错责任原则为中心明晰矿害责任的法律构造;对矿害责任承担规则予以具体化,以满足不同情形下矿害责任的司法规制;并应对矿害责任承担方式进行梳理,活用多种责任方式为受害人提供周延的救济。Liability of mining damage in our country did not receive due attention. The regulation rules are very simple and they can＇t provide effective relief for victims. The tension formed between the system supply and demands of justice. The legal liability of danger should be taken as the foundation of it,and its legal structure should be based on the principle of no fault liability. In order to satisfy the judicial regulation under the condition of different liability mining damage,the rules of liability of mining damage should be refined. And we should clarify the ways to assume liabilities,and provide complete relief for the victim.
