社会弱势群体公共文化/信息服务权利的公民权利范围归属——法律法规与学术研究之比较

摘　　要：论文从实际承担公共文化/信息服务职能的机构或项目着眼,将公共文化/信息服务权利(RAPCIS)界定为社会成员利用上述机构或项目获得资源和服务的平等和自由。进而从公民权利的范围切入,采用国际和国内两种公民权利范围的权威划定作为框架,分析法律法规文本和学术研究著述所梳理的中国社会弱势群体RAPCIS相关权利在其中的归属。在此基础上,论文指出对社会弱势群体RAPCIS作公民权视域的观察、研究乃至实践,是必要和有益的;同时,还应注意社会权利之外的公民权其他维度的全面考量。After defi ning the rights of accessing public cultural and information Services（RAPCIS） as the equality and freedom of all the members of society to access the public cultural and information institutions or programs for resources and services, the paper adopts two authoritative citizenship categories as the analytical framework to analyze which categories the socially disadvantaged groups＇ RAPCIS sort out from the laws and regulations, as well as from the academic researches belong to. Then it points out that it is necessary and benefi cial to study and practice socially disadvantaged groups＇ RAPCIS in the view of citizenship. Furthermore, the attention should be paid not only on the social dimension, but also on the legal, political and participant dimensions of the citizenship.
