摘 要:刑法立法阻却事由是指可以阻却刑法修正的各种事由。立足于立法面向的刑法教义学,立法者必须把刑法的明确性原则、人权原则、比例原则、效益原则等作为判断刑法立法阻却事由的标准。当一种行为已为刑法分则之罪名所涵摄、抽象性概念经由刑法解释或指导性案例可以明确、设罪违背比例原则要求的"无先而后"的逻辑规则存在、行使宪法规定的公民基本权利或立法效益明显低于立法成本时,即存在刑法立法阻却事由,立法者应停止这种刑法修正。Reasons for preventing legislation in Criminal Law refer to all kinds of reasons that can prevent the amendment of Criminal Law. Based on Criminal Law dogmatics in legislation, legislators should take the principles of definiteness, human rights, proportionality, efficiency and so on as the standard of judging reasons for preventing legislation in Criminal Law. It will exist reasons for preventing legislation in Criminal Law when an action is included in one charge of specific provisions of Criminal Law, abstract concepts can be confirmed by Criminal Law explanation or guiding cases, crimes that are set up violate the logical rule of no first but the latter in proportionality principle, the execution of fundamental rights of citizens regulated by constitution or legislative benefit is lower than the cost of legislation, then the legislators should stop this kind of amendment in Criminal Law.
