雾霾环境责任立法创新研究——基于现代环境责任的视角

摘　　要：雾霾危害是近年来出现的一个新的环境问题。运用现代环境责任理论,结合雾霾治理的实践,创新雾霾环境责任立法,是应对雾霾危害的重要途径之一。现阶段比较可行的创新选择主要是:一是理念创新。抛弃传统环境责任旧观念而选择现代环境责新理念,运用现代环境责任理论指导整个雾霾污染防治工作。二是原则创新。运用现代环境责任理论创新雾霾立法原则,实行和遵循"整体主义与风险预防"两者并行的双重原则。三是承担双重责任。创新后的雾霾防治立法与实施必须坚持和贯穿"预期责任与过去责任"两者并重的双重责任。四是构建雾霾环境责任新体系。创新后的雾霾环境责任新体系是由原则性责任、专门性责任、评价性责任、相关性责任等一系列责任有机构成的一个新体系。Haze harm is a new environmental problem appeared in recent years. The use of modern environmental responsibility theory,combined with the practice of haze governance and innovation of haze environmental liability legislation,is one of the important ways to respond to the haze. At the present stage,the feasible choice of the innovation is mainly： the first is the innovation of concept. That is to abandon the traditional concept of environmental responsibility and choose the new idea of modern environmental responsibility,using the modern environmental responsibility theory to guide the whole haze pollution prevention and control work. The second is the innovation of principle. That is by application to modern environmental responsibility theory to innovate haze legislative principles,to implement and follow the dual principles of collectivism and risk prevention. The third is to assume the dual responsibilities. Legislation of haze control and its implementation must adhere to and go through the dual responsibilities of both expected liability and past responsibility both. The fourth is to establish the new system of haze environment responsibility. The new haze environmental responsibility system after innovation is composed of principle responsibility,special responsibility,evaluation responsibility,relative responsibility.
