略论警卫工作立法的必要性

摘　　要：警卫工作是党和国家的一项重要工作,是公安工作的重要组成部分。由于没有相关立法,在警卫工作中遇到的很多新情况、新问题,尤其是一些涉法问题很难处理;由于缺乏法律监督和制约,部分警卫人员容易滋生特权思想,不经风险评估,想当然地采取警卫措施。在全面推进依法治国的新形势下,只有尽快推进警卫工作立法,将警卫工作完全纳入法律的框架下运行,才能适应建设法治国家、法治政府、法治社会,实现国家治理体系和治理能力现代化的总体要求,才能有效解决警卫工作实践中遇到的难题,为警卫工作的科学发展提供有效的制度保障。Security work is part of the public security work. Because of no legislation of security, there are some problems which are difficult to be resolved -- some security staff sometimes have a sense of privilege and some take some restraining measures without assessing risk. Under the new situation of comprehensively implementing governing the country by law, only by promoting legislation of security and doing security work entirely by law, can the require- ment be met of building a country, a government and a society under the rule of law, and can the modernization of managing system and managing ability realized, and can the difficulties of security practice resolved, the scientific development of security work ensured.
