摘 要:在任何一个国家或地区的劳资关系中,劳动争议的发生可以算是一种常态,因为在一个组织之中管理者和被管理者之间一定会有冲突和争议。劳动者为求取尊严和生存,有时会从事若干自力救济的群体性抗争活动,若当该等行为触犯刑法时,应该如何处罚?关于劳动者群体性抗争事件处罚与刑事政策,是任何一个国家或地区内部和谐稳定的重要政策之一。2011年5月1日我国台湾地区开始施行新的《劳资争议处理法》,增设了特殊刑事豁免规定,但内容颇多疑义,在施行后未必能解决现有难题,对于普遍存在的劳动者群体性抗争活动帮助不大。毕竟,劳动者抗争群体性事件问题的解决,最终仍须回归刑事政策研究。In terms of labor relations in any country or area, labor disputes can be regarded as a normal state because conflicts and disputes surely exist between both parties involved within an organization. Laborers, with the purpose of dignity and survival, will sometimes be involved in some kind of self-help group protests. How to punish if such behaviors of protests violate the Criminal law? Policies concerning punishment and criminal policy of laborer resistance behavior are of great importance to the internal harmony and stability of any country and area. On May 1, 2011, Taiwan Region of our country begins to implement the new “Labor Dispute Processing Law”, the new law setting up the special criminal immunity regulations but with much doubt. It cannot solve the existing problems and offers little help to laborers massive protests. After all, a solution to laborers massive resistance behavior will have to appeal to researches on criminal policy.
