论执行性地方立法良法标准

摘　　要：执行性地方立法是指有立法权的地方国家机关为执行法律、行政法规或上位法的规定,对法律、行政法规或上位法的规定作出适合本行政区域实际需要的深化、细化和补充而制定地方性法规、规章的行为。要制定出良好的地方性法规应当确定地方立法的良法实体标准和形式标准。执行性地方立法良法的实体标准包括以人为本的标准、促进地方经济发展和社会进步的标准、促进社会公平公正的标准、有利于社会稳定的标准。执行性地方立法良法的形式标准包括地方性标准、执行性标准、依据性标准、可操作性标准和简明性标准。执行性地方立法可以根据党的路线、方针政策就不适合时代要求的上位法作出创新性规定,但其范围限于弱势群体权益保障、公权力限制及公务员管理和社会公益保护等方面。The Implemental and Local Legislation refers to the act to make the administrative rules and regulations to deepen, detailed and supply the law, administrative regulations and provisions of other upper laws, according to the actual needs of the local areas by the local legislative organs. To formulate the good local regulations, we shall determine the standards of the entities and the form of the local legislations. The standards of entities for Implemental Legislation include the People oriented, to promote local economic development and social progress, to promote social fairness and justice. The form standards for Implemental Legislation include the locality, the enforceability, the accordance standards and the Authorization, the operational standard and the conciseness. Implementation of local legislation can make innovation in the upper law provisions which is not suitable for the requirements of the times according to the party＇ s lines, principles and policies, But the innovation scope is only limited to protecting the rights and interests of vulnerable groups, restricting the public power, managing the civil servants and protecting the social welfares, etc.
