摘 要:通过建立理论模型分析专利审查制度与专利无效制度在控制专利质量上的协同作用机制。研究发现:审查质量对无效制度事后控制专利质量效率具有非单调性影响。当专利质量总体较低时,提高审查质量会促进无效制度的效率;而当专利质量总体较高时,提高审查质量则会抑制无效制度的效率。在此基础上,提出了我国当前及以后中长期的专利质量控制政策建议。The synergy mechanism between patent examination and patent invalid litigation on the quality control of patent is analyzed through a theoretical model. It is found that patent examination would impose a non-monotonic effect on patent invalid litigation, when the overall quality of patent is relatively low, improving the quality of patent examination would promote the efficiency of patent invalid litigation; when the overall quality of patent is relatively high, improving the quality of patent examination would restrain the efficiency of patent invalid litigation. The policy proposals of patent quality control with respect to current as well as medium and long term are given on this basis.
