摘 要:劳工保护问题并不是双边投资协定的传统议题之一,然而晚近双边投资协定纷纷纳入劳工保护条款。就劳工保护投资争端而言,虽然存在仲裁实践,但劳工保护涉及公共利益,明确劳工保护投资争端的不可仲裁性更为恰当。中国在未来的缔约实践中不应一概排斥劳工保护新议题,而应选择审慎规定缔约方劳工保护义务,强调缔约方劳工事项的规制权,明确劳工保护投资争端的不可仲裁性,最终达到投资者利益和东道国权益的平衡保护。The issue of labor protection is not one of the traditional items of BIT, but a provision put into it in recent years. Though several cases relating to labor protection exist in arbitration practices, considering labor protection involving public interests, it is proper to clearly stipulate the unarbitrability of the international investment disputes relating to labor protection. China should stipulate the labor protection clause in its practice of signing future investment treaty, impose reasonable commitments and preserve the contracting parties' regulatory power in labor matters to achieve the goal of balancing investor protection and host country interests.
