知识产权边境保护制度研究演变轨迹评析

摘　　要：国内相关研究早期起于对美欧知识产权边境保护制度与战略的评介、比较,多从权利人本位出发,提出了本国立法的不足和国际当前立法的可借鉴性,研究观点往往跟随着国际舆论的导向。国内近期研究则逐渐表现出立足国情、对专项制度或热点问题进行深入研究的倾向。英文文献的研究更多集中于边境保护机制的微观问题上,或者热衷于对他国(尤其是发展中国家)相应制度的比较、评介甚至是指责,研究角度表现为单一的权利人本位。当前研究的总体状况是缺乏对知识产权边境保护制度国际化与本土化的全面研究,也缺少发展中国家的视角与声音,其中,南方中心的研究成为亮点。今后,知识产权边境保护制度研究需要从更全的主体视角和更宽的历史视域,动态性全局性地审视分析世界上典型的国际国内知识产权边境保护制度,以期得出更为平衡与综合性的研究结论。Most of the domestic studies in early stages, from the perspective of right-holders, concen- trated on introduction, comparison and evaluation of the legal system and strategies of IPR border protection in the US as well as in EU countries. These studies usually try to identify the defects of the corresponding regulations in China and at the same time suggest references to foreign legislations. Furthermore, the stance or the views offered often echoed the worldwide trend. In contrast, recent researches tend to explore profound- ly into some specific regulations and hot issues in IPR border protection both at home and abroad, while a great amount of English literature focus on the detailed analysis of specific micro elements concerning IPR border protection and these studies tend to identify and criticize those problematic aspects in regulations of countries other than their own, especially those of developing countries. In general, nowadays the researches are lack of a comprehensive global and local study of the regulations of the IPRS border protection, as well as of the views and voices from the developing countries. However, the research outcomes of the South Center are eye-catching. From now on, we deem it a must that more perspectives from various different parties and wider historical focuses in the research of the legal system concerning IPR world-wide be included. In this way, some more balanced, objective and comprehensive viewpoints could be expected.
