我国网购中第三方物流法律现状及对策分析

摘　　要：分析了网购中第三方物流存在的问题及我国网购中存在的第三方物流的相关法律问题,指出应对我国网购中的第三方物流的立法加以完善,明确第三方物流合同的法律性质,网购中第三方物流的诉讼管辖范围,网购中第三方物流纠纷的举证责任,网购中第三方物流的法律责任,实现网络环境下第三方物流的可持续发展。In this paper, we analyzed the problems existing in the online shopping related TPL legal systems, and then pointed out that we should improve the TPL related legislation concerning online shopping, and clarify the legal nature of the TPL contracts, the jurisdiction over the TPL in online shopping, the burden of evidence in online shopping related TPL disputes and the legal responsibility therein.
