论邪教的不法性及其规制

摘　　要：不法性就是指事物在静态和动态上不符合法律规定的属性。邪教非宗教,其在信仰对象、组织性质和社会功能等方面与正规合法宗教有明显区别,邪教会危害国家安全、社会稳定和公民人身财产安全,具有不法性。法律是一种有效的规制邪教的工具。一些国家制定了专门的反邪教法,并成立了专门的行政机构以加强司法打击邪教的力度和措施,这对于我国当前对邪教的规制具有借鉴意义。制定专门的反邪教法律、改革宗教管理制度、完善宗教政策和开展国际合作是我国当前规制邪教不法性应采取的对策。Illegality means the attribute of a thing in the static and dynamic state that does not meet the law.Cult is not religion.The former has different belief objects,organizational property and social functions from the latter.The cult can endanger national security,social stability and people＇s person and property safety,and it is illegal.The law is an effective regulatory tool for cult.Some countries have developed special anti-cult law,established special administrative bodies and strengthened judicial crackdown measures,which have reference to China.The establishment of special anti-cult law,reform of religion management system,improvement of religious policy and development of international cooperation,is the important countermeasures for our county to regulate the cult.
