摘　　要：涉及安徽省与浙江省的新安江流域生态补偿试点是我国首个跨省界流域生态补偿试点。作为一种流域环境治理的新型协议,新安江协议在法律上具有对赌协议的性质,它确立了一种推动流域相关地区之间环境合作博弈的一种新型的契约法律机制。地方政府之间这种通过法律契约形式进行环境合作博弈的方式,改变了传统意义上中央政府对于跨行政区域环境保护的垂直命令式的单一环境管制方式,其推动、激励相关地方政府相互合作、共同治理的做法,对于解决我国跨行政区域水资源保护、水污染治理具有重要的理论价值和现实的实践意义。环境法的勃兴源自于当代社会的环境危机,立足于解决当代社会所面临的环境问题,倡导与践行环境保护的实践理性精神是环境法的应有之意。对于新安江协议这种地方性法律合作与创新,因而应当秉持鼓励与包容的实践理性精神。Being the first experimental and trans - provincial ecological compensation site, The Xin＇ anjiang River Basin Ecological Compensation Agreement is concerned with the relationship between two provinces： Anhui＂ and Zhejiang. As a sort of totally new type of river basin environmental governance treaty, Xin＇ anjiang Agreement shares the nature of valuation adjustment mechanism. It has created a new sort of mechanism which pushes forward environmental governance cooperation between the relevant regions. The practice of environmental cooperation games based on legal contracts by the local governments has changed the traditional way of environmental management, that is, an instruction coming down directly from the Central Government on trans - administrative regional environmental governance. This has contributed great theoretical and practical value to push forward and encourage local governments to cooperate in dealing with the co - related problems and with the issue of water resource protection and water pollution controlling. The development of environmental law roots from the environmental crisis in modern society, aiming at solving the pressing environmental problems facing to the modern society. In this sense, encouraging and conducting practical rationality should be the essence of environmental law. We should give more support and patience to the local legal cooperation and innovation embodied in Xinanjiang Agreement.
