论国际法上区域组织使用武力1与集体自卫的区别

摘　　要：《联合国宪章》的主要两种合法使用武力的情形都包含了区域组织的因素,分别表现为在宪章第八章关于区域组织使用武力的规定,以及关于集体自卫的规定。但是,区域组织的这两种使用武力情形不可混淆,不可相互替代,通过对两处规定进行体系解释可以发现,在安理会采取必要办法之后,集体自卫权不得继续行使;相反,只有在安理会授权相关区域组织使用武力时,该区域组织才可以依据宪章第八章规定使用武力。The two main types of legitimate use of force in UN Charter contained the factor from regional organi-zations.Both the rules about use of force by regional organizations in Chapter Ⅷof UN Charter and the rules about collective self-defense proved it .However , the two kinds of use of force by regional organizations can not be re-placed .Through the systematical interpretation of them , we can find that the right of collective self -defense would be prohibited after the Security Council takes necessary actions .Only with the authorization of the security council can the regional organizations use force according to the Chapter Ⅷ.
