摘　　要：法国现代调解制度的发展是本土资源和外来经验结合的产物。它是传承18世纪法国大革命时期的调解立法,借鉴英美法系调解经验的基础上,在法国现代社会条件下发展的结果。法国的调解目前已形成独具特色的模式,即由国家依附型调解和社会自治型调解组成的混合模式。而从国家依附型调解逐渐过渡到社会自治型调解,已成为法国调解改革的基本方向。The modern French mediation is a combination of innovation between local resources and foreign experience.In detail,it is the conciliation legislation heritage during the Revolution of 18 th century,combined with the Anglo-American mediation experience,according to the modernization conditions of the French society,finally producing the innovative results.Today,French mediation apparently has formed its own characteristics of the modern mode,composed of National-dependent conciliation and social self-dependent mediation.From National-dependent conciliation to social selsf-dependent mediation is the future of the modernization of French mediation.
