摘　　要：民事恶意诉讼行为当属于民事侵权行为。大陆法系和英美法系分别对恶意诉讼的侵权性质和规制做出了规定。我国亦应从侵权责任的构成要件及识别、承担方式等方面建立和完善民事恶意诉讼的侵权责任制度。Civil malicious lawsuit behavior belongs to civil tort. Continental law system and Anglo- American law system for malicious prosecution tort nature and regulation to make the rules. Our country also should from the components of tort liability and the recognition and bear the way to establish and improve the system of civil tort liability of malicious prosecution.
