摘　　要：根据新建项目对煤炭资源的压覆审批流程和煤炭资源国有属性的特点,新建项目压覆煤炭资源行政管理面临的问题主要来自法律、行政、经济三个方面。分析新建项目压覆煤炭资源行政管理现状可知,矿业权人和国家的权益在压覆过程中没有得到很好的维护;缺少专门的管理办法,现有的行政审批难以有效地解决我国当前面临的煤炭资源压覆问题,行政审批职能部门协调困难、衔接有漏洞;缺少合理完善的经济补偿机制,建设方所交费用与压覆煤炭资源的价值不符,补偿款不到位。建议:(1)制定专门的压覆煤炭资源管理办法;(2)完善行政审批流程;(3)健全压覆补偿机制。Based on approval process and the characteristics of state-owned property of coal resources, the main problems that we face in governing coal resources constructed over the new project involves legal, administrative, and economic aspects. This paper introduces these problems as follows： persons owned the mineral right and the rights and interests of the state aren＇t protected well in the process of covering; lack of specialized management approach, and the problems that we face in constructed over coal resources cannot be efficiently resolved by the existing administrative examination and approval; the functional department responsible for administrative approval is quite difficult in coordination and connection; lack of reasonable and perfect economic compensation mechanism, and fee paid by the building side does not assort with the value of covered coal resources; and the compensation is insufficient. For that reason, this paper suggests that we should formulate special management measures, perfect the administrative examination and approval process, and build sound compensation mechanism.
