摘 要:在特定动产"一物数卖"中,基于合同的相对性,数个买受人均可获得以出卖人继续履行合同义务即交付买卖标的物为内容的终局判决。这样,判决进入执行程序后遭遇执行竞合,导致前位买受人优先权无法实现,非前位买受人也无法实现预期利益。解决该问题的关键在于优先权的确认以及对错误判决的纠正。对此,撤销原判发回重审的做法充分实现了审判监督权与诉权的有效配合,为前位买受人以有独立请求权第三人资格参加重审提供了可能,便于破解该执行竞合问题,实现对前位买受人的有效救济。When the specific movable property is sold for times, all of the buyers can gain the final judgment which requires that the seller should continue to perform the contract obligations and deliver the subject of the contract based on the relativity of the contract. When the judgment encounter the compulsory execution coincidence in the execution phase, which will make the foregoing buyer can not realize the priority and the later buyer can not gain the expected benefits, too. To resolve these problems, the priority should be confirmed and wrong judgments be corrected. Therefore, quashing the original judgment and remanding for retrial fully embody the effective cooperation of the judicial authority and the actiones utiles, which makes it possible for the third parties with independent claim to attend the retrial. It will be convenient for solving the compulsory execution coincidence and realizing the effective remedy for the foregoing buyers.
