公共性视野下的古城保护

摘　　要：古城是宝贵的历史文化遗产,具有公共性。古城保护理应在政府主导下,形成古城保护各行为主体的合作治理模式,关照各方利益。我国古城保护取得了丰硕的成果,形成了保护的基本法律体系,构建了古城保护的基本制度,但古城保护对古城公共性的考虑不足。在公共性缺失背景下,被动保护和建设性破坏并存,地方政府和开发商的强逻辑主导着古城保护进程,公众参与缺失。保护城市历史文化遗产,须在公共性指引下,协调古城保护和发展,合理定位古城价值和古城保护目标,并最终落实到古城保护规划的完善、古城保护博弈平台的搭建及古城保护机制的构建上。Ancient cities are precious urban cultural heritage, and have the characteristic of publicity. Protection of ancient cities should adopt cooperative governance model under the guidance of the government and take care of the benefits of all parties. Protection of ancient cities has achieved fruitful results, including the basic legal system and basic protection system. But we don＇t pay enough attention to publicity in the protection of ancient cities. Under the background of deficiency of publicity, passive protection and constructive destruction coexist, local governments and land agents dominate the protection of ancient cities, and the public participation is inadequate. Under the guidance of publicity, we should coordinate the relationship between protection and development, reasonably position values of ancient cities and goals of protection of ancient cities, and ultimately make it into the improvement of ancient city＇s planning, the establishment of benefit game platform, and the construction of protection mechanism of ancient cities in order to protect urban cultural heritage.
