摘　　要：本文从一个独特的视角——考察和比较罗马法的流失部分和传世内容,归纳和总结罗马法的核心要素及其对西方社会文明、制度文明的贡献。考察比较表明,罗马法留传至今,其内容大部分都流失了,而且保存下来的文本在结构体系和内容方面,并没有强于其他几个文明的代表性法律文本;它的真正生命力所在,就是构筑了西方文明的制度基础。With the very way of thinking about Roman law,the author digs deeply into those items lost as well as those passed down,and compare them with each other. He finds there is nothing more important in Roman law than that in other civilization such as traditional Chinese Law or Islamic Law System in respect to structure and content of legal system. What establishes the importance of Roman law is its contribution to the institutional civilization of the West.
