刑事政策视野中的社会管理创新——以社区矫正为视角

摘　　要：近些年来,我国刑事领域在不断地进行社会管理创新,其中包括试点成功之后已被法律确认的社区矫正。这一创新属于实现刑事政策的、战术层面的举措,因而需要对其从刑事政策的角度加以审视。审视结果表明,我国官方文件对于社区矫正的界定既脱离我国的立法实际,也不符合国际社会的通例,漠视罪犯的人权,而且还有选择性保护之嫌,不符合我国反制犯罪的刑事政策总体战略,影响我国社区矫正制度本身的完善与发展,阻断了矫正一体化的进程,缺乏反制违法犯罪的艺术,故而亟待取消这一不当界定,重新对其进行定位,以避免对我国反制犯罪的战略继续产生不利影响。In recent years, innovation in social managements has being implemented continually in criminal field in China, including community corrections which had been recognized by law after the success of it＇s pilot. This innovation is ameasure to realize criminal policy on tactical level, so it needs to be examined from the perspective of criminal policy. The results show that the definition of community corrections by our official documents not only depart from our legislative practice, but also inconsistent with the general rule in international community, it disregards of the human rights of criminals, and there is synonym of selective protection, and inconsistent with the general strategy of our criminal policy to against and resist crime, affects the improvement and development of community corrections system itself, blocks the integrated process of corrections in our state, lacks of arts to against and resist illegal crime. Therefore, this improper definition should be canceled urgently, and should be re-defined to avoid further adverse affect to our strategy of against and resist crime.
