农民工工伤保险:保险补偿模式适用经济分析

摘　　要：农民工工伤保险运行低效,工伤保险补偿模式的适用是主要问题之一。当前世界各国主要有排他性、选择性、补充性和双重性四种补偿模式,各种模式有其适用的条件和环境。我国农民工工伤保险补偿模式规定不详尽,各地实践模式有所不同,急需明确规定工伤保险补偿模式,以解决当前工伤保险补偿模式规定缺位与各地工伤补偿标准不一的状况。从工伤保险补偿金额、工伤事故法律服务费、减少工伤事故以及裨益于民工身体康复和职业康复等角度分析,农民工工伤保险补偿宜采用补充性补偿模式。The operation efficiency for the migrant workers＇ work-related injury insurance is very low,and the application of the mode of work-related injury insurance compensation mode is one of the main problems.Currently,countries all over the world have four modes of compensation,that is,exclusive,selective,complementary and duality.The each kind of pattern has its own applicable conditions and environment.The regulation of China＇s migrant workers work-related injury insurance compensation mode is not in great detail and the practical pattern in each place is different from each other.Now it is badly needed to have a clear regulation of work-related injury insurance compensation mode to solve the current absence of work-related injury insurance compensation mode and the conditions of different compensation standard.From the aspects of the amount of compensation of work-related injury insurance,the work-related injury accident legal service,reducing the work-related injury accident and the benefit for recovery of migrant workers and vocational rehabilitation,the paper put forward the suggestion that the migrant workers work-related injury insurance compensation should use supplementary compensation mode.
