非诉类法律服务在政府建设项目管理中的应用

摘　　要：政府投资建设项目与一般投资项目相比,具有投资规模大、管理程序严格、建设周期长、社会影响广泛等显著特点,涉及大量部门审批以及合同起草、谈判、签订、执行、修订事宜等民事行为。在项目筹备、建设、运营阶段引入非诉类法律服务,对于预防和化解合同违约风险尤为重要。Compared with the general investment projects, the government invested projects have some notable features including larger investment scale, more strict management procedures, longer construction cycle and wider social impact which are related to the examination and approval by large number of departments and to the civil behaviors including drafting, negotiating, revision, signing and implementation of the contract. The introduction of non litigation legal services in the project preparation, construction and operation, may prevent and dissolve the risk of breach of contract Combined with the actual situation, this article discussed and analyzed the practical application of non litigation legal services in the construction work.
