摘 要:全面深化改革及依法治国背景下,我国土地储备制度面临新的发展要求。基于制度变迁及制度绩效评价的视角对我国土地储备制度演进进行剖析,并结合国外典型经验,以制度转型路径的顶层设计为前提,从法律体系、财税体制、投融资机制等六个层面对新时期我国土地储备制度转型的内在逻辑进行思考,进而提出了土地储备由经营性向公益性转变、土地储备机构由管理型向服务型转变等方面的有效路径,促使其更好地服务于我国新型城镇化进程。Under the background of comprehensively deepen reform and the rule of law, land reserve system in China is facing a new development request. In this paper, based on the perspective of system change and system performance evaluation to analyze the evolution of our country land reserve system, and combined with typical experience abroad, on the premise of institutional transition route of the top-level design, giving the inherent logic of their thoughts to the transformation of our country land reserve system in the new period from the legal system, fiscal and taxation system, investment and financing mechanism and so on six aspects.And then puts forward the effective path that land reserve by the business to the public welfare, land reserve institution from administration to service and so on, to better serve the new urbanization process in China
