摘 要:中央政府已经设立中国(上海)自由贸易试验区,并施加上海市承担改革开放试点的任务。但是全国人大及其常委会没有授权其突破现行滞后的体制和机制,由此导致自贸试验区改革法律依据不足,造成改革开放与法治不协调。实现中国(上海)自贸试验区改革开放的法治路径包括:立法者更新观念和积极行使权力;最高权力机关积极授权,授予上海市人大及其常委会制定自贸试验区法规的变通立法权,授予上海市人民政府制定自贸试验区规章的立法变通权。此外,相关国家机关要积极修改或者废除相关法律、法规、规章。The Central People′s Government of China has approved the establishment of China (Shanghai) Pilot Free Trade Zone ,and imposed a task for Shanghai municipal to carry on the test of reform and opening‐up .However ,the National People′s Congress and its Standing Committee don′t empower Shanghai to break through the hysteretic System and mechanism ,thus Shanghai municipal has no Sufficient legal basis for the above reform and opening‐up .As a result ,there are disharmony between the reform and opening‐up ,and rule of law .China should choose the path of rule of law to implement the reform and opening‐up of China (Shanghai) Pilot Free Trade Zone .Firstly ,the legislators should renovate concepts and exercise powers actively . Secondly ,the highest power organs should empower the Shanghai municipal People′s Congress and its Standing Committee ex‐ercise accommodation power in legislation concerning China (Shanghai) Pilot Free Trade Zone ,and should empower Shanghai municipal People′s government to have accommodation power in local government regulations concerning China (Shanghai) Pi‐lot Free Trade Zone .Finally ,related state organs should positively amend or abolish relevant laws ,rules and regulations .
