摘 要:环境保护检举权是一项具有公法性质的权利,它为公民参与环境治理提供了通道。我国环境保护领域中的诸多法律、法规、规章对此项权利作出了规定,但该项权利的权利主体、义务主体和权利内容的规范内涵尚需厘清。有关环境保护检举权的争议诉诸行政诉讼,在我国不存在制度障碍,但需要注意司法审查强度的合理运用。这对纯粹以保护环境公共利益为目的检举人具有重要意义,其公益诉求无须诉诸作为客观诉讼的行政公益诉讼,在作为主观诉讼的行政私益诉讼中即可获得救济。我国环境公益诉讼制度的推进和完善,应该重视检举权的这一制度功能。The report right with nature of public law provides a channel for people to participate in environmental govern- ance in environmental law. This right is expressly provided in our environmental law, but the normative connotation still need to be clarified such as its owners, obligor and content of rights. There is no institutional barriers for this right' dispute to resort to administrative litigation apart from paying attention to the rational use of judicial review intensity. For the whistle--blowers to protect the environment solely for the purpose of public interest, it is important, because of its public demands without re- sorting to litigation as an objective administrative public interest litigation, to obtain relief in administrative proceedings as sub- jective private interest litigation.The function of report rights should be taken seriously in promoting and improving the process of environmental public interest litigation.
