韩国行政审判制度的发展与完善方向

摘　　要：韩国的行政审判制度虽然最初是基于《诉愿法》的实施而导入,但早期的行政审判制度不仅未能发挥其权利救济机能,反而被认为是行政诉讼的阻碍。对此,宪法新设了"作为诉讼的前置程序,可以进行行政审判。行政审判的程序由法律规定,应当准用司法程序"的规定。依据该宪法规定,韩国制定了《行政审判法》,并通过数次的修订,逐步强化了行政审判程序对司法程序的准用。如今,在该制度已经接近了宪法所设定的目标,即达到了对司法程序的准用后,行政审判制度今后的发展方向是亟待探讨的问题。行政审判制度作为一种准司法化的程序,其区别于以实现行政自我监督机能为核心价值的其他行政不服程序;而同时,行政审判制度作为一种以权利救济为目标的行政不服程序,其又区别于作为司法程序本身的行政诉讼制度。应怎样使韩国的行政审判程序在行政程序和司法程序之间凸显其存在的自身价值,是行政审判制度今后的发展使命。Although initially started from the Petition Law, the administrative judicial system in South Korea did not play its role as right relief but was viewed as the obstruction of the administrative litigation in early times. As regard for this, the constitution set up the rules of ＇the administrative trial can be carried out as the pre-litigation procedure and its procedure should be regulated by law, to which the judicial procedure can be applied.＇ Based on this, the Administrative Judicial Law was made, which, as well as its many times amendments, strengthens the application of judicial procedures to the administrative judicial procedure. Nowadays, since the system has nearly achieved the goal set by the constitution, i.e. the application of judicial procedures, its future development direction becomes an urgent issue to be discussed. Being as a form of judicial procedure, the administrative judicial system is different from the other administrative procedures which focus on self-monitoring, while being as a form of right and interest relief procedure, it is different from the other administrative litigation systems being judicial procedures. To highlight its existence value between the administrative procedure and judicial procedure will be the future mission of the administrative judicial system development in South Korea.
