摘 要:学说对于政府采购行为的法律性质存在分歧。《政府采购法》虽然认定政府采购合同为民事合同,但也认识到民事行为理论无法涵盖全部采购活动,因而采取了分段处理的方式。但是,其对采购人选择供应商这一阶段的行为定性不明,导致设计的争端解决机制链条过长,效率低下。针对这一问题,其他学说如行政合同说、行政私法行为说和混合合同说均难以提供完善的解决方案。借鉴域外"二阶段理论"来定位政府采购行为是可取的改革方向。There is disagreement on the nature of the government procurement behavior among theories. Although the Government Procurement Law defines the related contracts as the civil ones, it still recognizes that related civil behavior theories can not cover all procurement behaviors; hence the segmentation approach is taken. However, the unclear identification of the vendor selection stage leads to the too long design of the dispute settlement mechanism chain, causing low efficiency. For this issue, other theories such as the administrative contract, the administrative private law act, or the mixed contract can not provide complete solutions. Therefore, reference to the foreign two-stage theory may be taken as a possible reform direction to identify the government procurement behavior.
