嫖宿幼女罪当废除——以杨德会案为例

摘　　要：嫖宿幼女罪指明知是不满14周岁的幼女而与之发生性关系的行为的犯罪。其设立目的主要是保护未满14周岁幼女的身心健康。其目的是好的,但具体到实践中,出现了很多问题,如嫖宿幼女罪有违道德伦理;有违法律的平等价值观;与强奸罪相混淆,造成逻辑混乱等等。另外,成立"嫖宿幼女罪"有个前提,即:在与幼女发生性关系时"知道"对方为幼女,这会为确定成立"嫖宿幼女罪"增加难度,最终以无罪逃脱法律责任。嫖宿幼女罪存在种种弊端,嫖宿幼女罪已失去其存在的价值和必要性,应将其废除。Crime of whoring with a girl？ knowingly refers to a girl under 14 years of age and with criminal acts of sexual relations. Its main purpose is to set up under the protection of the health of young gifts 14 years of age. Its purpose is good, but specific to the practice, there have been many problems, such as crime of whoring with a gift.9 against the moral theory; contrary to the law of equal value; and rape confused, causing confusion and so logical. In addition, the establishment of the ＂ crime of whoring with a gift？ ＂ has a premise, namely ： in the event of a sexual relationship with a gift ＂know＂ each other as young gifts, which will determine the establishment of the ＂crime of whoring with a girl？＂ more difficult, and ultimately to escape liability for innocent. Faced with the drawbacks, crime of whoring with a gift has lost the value and necessity of its existence, it should be repealed.
