论行政审批权下放监管的法律对策——以行政审批制度改革为视角

摘　　要：由于长期形成的"权力"意识根深蒂固,我国监督权力行使的法律和制度不完善,行政审批权在取消或下放行使中存在许多违规操作的问题,阻碍了行政体制改革进程和市场经济体制的建立。行政审批制度改革要符合市场经济发展要求,就必须加大行政审批权下放行使的监管力度。通过明确审批监管机构职责和责任,强化依法规范行使权力的监督,完善监管法律和制度,提高审批监管人员法律和技术素养,让行政审批制度改革的成果真正起到实效。Due to the ＂power＂ consciousness deeply rooted, supervision legal system and the exercise of power in China is not perfect, and the administrative examination and approval power in the cancellation or exercise in the presence of many illegal operations decentralization problem hinders the establishment of administrative system reform and market economic system. In order to realize the reform of administrative examination and approval system, the system must conform to the request of market economy develop- ment, and we must strengthen the supervision of administrative examination and approval and the decen- tralization exercise. Through the explicit approval of regulators duties and responsibilities, strengthening supervision and standardizing the exercise of power, perfecting the supervision of law and system, impro- ving the examination and approval supervision personnel of legal and technical literacy and other means, we can make the reform really play its effective role.
