摘 要:近年我国城镇化率不断提高,大量农民的离土进城为农村土地使用权流转提供了平台。土地信托是土地流转中的一项制度创新,是深化农村土地经营机制的必然需求,也是促进土地使用权规范有序流转的必由之路。但现阶段,我国农村土地信托的顺利开展还面临着诸如法律框架不健全、农业经营风险与农民持续受益相矛盾、信托公司专业能力不够等等系列难题。本文选取专业信托公司作为受托人以探索新型农村土地承包经营权信托方式,可以实现土地"纸上确权"及高效利用,在引入合适的管理方进行土地经营后,可以为农民、地方政府、信托公司、土地承租方带来不同收益,从而达成多方共赢,为我国农村土地流转探索了新途径。In recent years, China's urbanization rate continues to increase. A large number of farmers into the city, which provides a platform for the transfer of land use fights in rural areas. Land trust can facilitate the orderly transfer of land use rights norms. But at this stage, the smooth development of China's rural land trust is also facing such as the legal framework is not perfect, the risks associated with agricultural operations continue to benefit farmers in contradiction, trust is not enough expertise and so on. This paper selected professional trust company as trustee in order to explore new rural land contract and management rights in trust, which can be achieved land ownership in face and efficient use; after the introduction of appropriate land manage- ment side business, which can reach a win-win situation between the farmers, local governments, trusts, land lessee. And it ex- plores a new way for the rural land circulation in china.
