摘 要:小产权房是中国特有的现象,它是通过房产开发商和村委会合作,或者村委会自行组织在农村集体土地上建设,以销售营利为目的,向非本集体经济组织成员销售的房屋。但由于小产权房缺乏其存在的法律基础,它在合法性、权利归属、流转效力等方面难以得到法律的保障,维护权益方面也难以获得有效的救济。the small property rights house as Chinese phenomenon, which can cooperate through real estatedevelopers and the village committee, village committee to organize or construction in the rural collective land, tosell for profit, to non members of the collective economic organization of the housing sales.
