摘　　要：婚内是否存在"强奸"争论已久,该争论的焦点在于婚姻关系中存在同居权,即夫妻双方享有性生活权利。持反对意见者认为这既是一种权利,又何来"强奸"之说。然而越来越多的学者持肯定意见,认为即便夫妻双方享有性生活权利,但也应当尊重任意一方的性自主权。该问题的本质是同居权与性自主权的冲突,这是人权发展的必然结果。The existence of marital 'rape' has long been debated,the focus of the debate is the existence of the right to marital cohabitation relationship,namely the right to life of the couple enjoys sex.Dissenting believes this is not only a right,how can there be 'rape' argument.However,more and more scholars hold a positive view that even if the couple enjoys sex right,but should respect the autonomy of either sex.The essence of the problem is a conflict of conjugal rights and sexual autonomy;this is the inevitable result of the development of human rights.
