“法律孤儿”的人权保障现状及其对策

摘　　要：目前我国"法律孤儿"的人权保障现状形势严峻,"法律孤儿"的生存权没有受到足够的重视、发展权保障形势不容乐观、公正权没有受到全面的保障、获助权没有得到有效的落实。为了保障"法律孤儿"的合法权益,帮助其健康快乐成长,既需要政府加大财政的投入力度,建立健全"法律孤儿"人权保障的法律法规;又要增强"法律孤儿"及其相关主体的人权意识,构建政府、社会、学校和家庭"四位一体"的"法律孤儿"人权保障机制,形成合力保障"法律孤儿"的人权。It＇s a severe situation of the present status of Legal orphans human fights protection in China. Legal orphans＇fight to ex- ist is not pay enough attention and the development security situation is not optimistic, fights that be treated justice are not comprehen- sive security, and rights that to be helped have not been effectively implemented. In order to protect the legitimate rights and interests of Legal orphans, to help the healthy and joyful growth, needs both the government increasing financial investment, establish and im- prove the Legal orphans＇human rights protection laws and regulations; And to strengthen the Legal orphans＇and its related main body＇s consciousness of human right, build the Legal orphans＇human rights protection mechanism which let the government, society, schools and families ＂four in one＂, forming resultant force to protect Legal orphans＇human rights.
