关于健全我国旅游行政执法体系的若干思考

摘　　要：旅游行政执法是我国行政执法体系的一个分支,也是旅游行政管理的重要环节。旅游行政执法的法律依据、执法主体、执法方式、执法程序、执法原则等共同构成旅游行政执法体系,它的发展与完善对深化旅游行政管理、加强旅游行业管理具有重要意义。本文通过梳理旅游行政执法体系中有关法律依据、执法主体、执法方式的内容,提出体系中存在的旅游立法不全面、法律解释不到位、执法理念异化、执法队伍不完善、执法工作冲突及落实困难、执法监督缺位等问题并给出建议,以期对健全我国旅游行政执法体系有所帮助。The tourism administrative law enforcement is a branch of the administrative law enforcement system in China,and also an important part of tourism administration. The legal bases,subjects,forms,procedures,principles of the tourism administrative law enforcement together constitute the tourism administrative law enforcement system. The development and perfection of it is important to deepen the tourism administration and strengthen the tourism industry management. This Paper sorts out the current developing situation of the tourism administrative law enforcement system,discusses the existing problems that the tourism legislation is not comprehensive,the legal interpretation is inadequate,the legal concept is alienation,the law enforcing teams are not perfect,the enforcement is in conflict and difficult to be fulfilled,the supervision of law enforcement is absence,and so on. Then some suggestions are made with best wishes to help perfecting the tourism administrative law enforcement system.
